Both formal and legal ownership are political categories - non of them
are in anyway objective, but exclusively dependent on local cultural
categories - and 'possession' is more often than not (at least in a
western context) based on 'common law' (the law is created and/or
refined by judges) which makes it somewhat difficult to make the
distinction you mention - due to 'possession' being underwritten by a
legal complex.
